- "Booking" means a confirmed reservation for any of our Services.
- "Traveler" or "Guest" refers to any person who participates in our Services.
- "Lead Traveler" is the person who makes the Booking and serves as the primary contact.
- "Third-Party Suppliers" includes hotels, restaurants, transportation providers, and other service providers we work with.
- "Itinerary" refers to the detailed plan of the tour or service as described in your booking confirmation.
- "Force Majeure" means events beyond reasonable control, including natural disasters, acts of terrorism, pandemics, or government actions.
3. Booking Terms
3.1 Booking Process
All bookings are subject to availability and confirmation by Serenity Morocco Tours. A booking is considered confirmed only when:
- You have received a written confirmation email from us
- The required deposit or full payment has been received
- You have accepted these Terms of Service
3.2 Accuracy of Information
You are responsible for ensuring that all information provided during the booking process is accurate and complete. This includes:
- Full legal names of all travelers (as they appear on passports)
- Accurate contact information
- Special requirements, dietary restrictions, or medical conditions
- Valid travel documents and visa requirements
We are not responsible for any issues arising from incorrect or incomplete information provided by you.
3.3 Minimum Age Requirements
Most of our tours are suitable for travelers of all ages. However, certain activities may have age restrictions. These will be clearly indicated in the tour description. Children under 18 must be accompanied by a parent or legal guardian.
3.4 Special Requirements
Please inform us of any special requirements, mobility issues, dietary restrictions, or medical conditions at the time of booking. While we will make reasonable efforts to accommodate your needs, we cannot guarantee that all requests can be fulfilled.
4. Payment Terms
4.1 Pricing
All prices are quoted in the currency indicated (typically MAD, EUR, or USD) and are subject to change without notice until a booking is confirmed. Prices include:
- Services as described in the itinerary
- All applicable taxes (unless otherwise stated)
- Standard inclusions as listed in the tour description
Prices do not include: international flights, travel insurance, visa fees, personal expenses, tips and gratuities, optional activities, or items not specifically mentioned in the inclusions.
4.2 Deposit and Balance Payment
A non-refundable deposit of 30% of the total booking value is required to confirm your booking. The remaining balance is due 30 days prior to the tour start date. For bookings made within 30 days of departure, full payment is required at the time of booking.
4.3 Payment Methods
We accept the following payment methods:
- Credit/Debit cards (Visa, Mastercard, American Express)
- Bank wire transfer
- PayPal (subject to additional processing fees)
4.4 Currency and Exchange Rates
If you pay in a currency different from the quoted price, the exchange rate at the time of payment will apply. We are not responsible for any fluctuations in exchange rates between the time of booking and payment.
4.5 Late Payment
Failure to pay the balance by the due date may result in automatic cancellation of your booking and forfeiture of the deposit. We reserve the right to charge late payment fees of 2% per week on overdue amounts.
5. Tour Services
5.1 Itinerary Changes
While we make every effort to operate tours as described, we reserve the right to modify itineraries when necessary due to:
- Safety concerns or unforeseen circumstances
- Weather conditions
- Road closures or transportation disruptions
- Venue closures or unavailability
- Government regulations or advisories
In such cases, we will provide suitable alternatives of comparable quality. No refunds will be provided for minor itinerary changes that do not substantially affect the overall tour experience.
5.2 Accommodation
Accommodation is provided as specified in your booking confirmation. Room types and amenities may vary. We reserve the right to substitute accommodation of similar or higher standard if necessary.
5.3 Transportation
Transportation is provided in comfortable, air-conditioned vehicles appropriate for the group size. Vehicle types may vary based on availability. All drivers are licensed and experienced.
5.4 Guides
Our tours are led by licensed, professional guides. Guide assignments may change based on availability. All guides are vetted for experience, knowledge, and customer service skills.
6. Traveler Responsibilities
6.1 Travel Documents
You are responsible for obtaining and carrying all necessary travel documents, including:
- Valid passport with at least 6 months validity beyond your travel dates
- Appropriate visas for Morocco and any transit countries
- Health certificates or vaccination records if required
- Travel insurance documentation
We are not responsible if you are denied entry to Morocco or any other country due to inadequate documentation.
6.2 Health and Fitness
You must ensure that you are physically and mentally fit to participate in the tour activities. Some tours involve walking on uneven terrain, climbing stairs, or exposure to heat. Please review the tour requirements carefully and consult your physician if you have any concerns.
6.3 Conduct
Travelers are expected to:
- Respect local customs, traditions, and laws
- Follow the instructions of guides and tour leaders
- Be punctual for all scheduled activities
- Treat fellow travelers, staff, and locals with respect
- Dress appropriately for cultural and religious sites
We reserve the right to remove any traveler whose behavior is disruptive, dangerous, or inappropriate, without refund.
6.4 Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and baggage loss. Proof of insurance may be required before departure.
7. Limitation of Liability
7.1 General Limitation
To the fullest extent permitted by law, Serenity Morocco Tours shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.
7.2 Third-Party Services
We act as an intermediary for certain services provided by third parties (hotels, restaurants, transportation providers). While we carefully select our partners, we cannot be held responsible for their actions, omissions, or the quality of their services. Any claims related to third-party services should be directed to the respective provider.
7.3 Personal Injury and Property Damage
We are not liable for any personal injury, illness, death, or property damage unless caused directly by our negligence. You participate in all tour activities at your own risk.
7.4 Maximum Liability
In any event, our total liability shall not exceed the total amount paid by you for the specific service giving rise to the claim.
7.5 Indemnification
You agree to indemnify and hold harmless Serenity Morocco Tours, its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your negligent or wrongful acts.
8. Cancellation & Refunds

Key points include:
- Cancellations made more than 60 days before departure: Full refund minus administrative fee
- Cancellations 30-60 days before departure: 50% refund
- Cancellations 15-29 days before departure: 25% refund
- Cancellations less than 15 days before departure: No refund
All cancellation requests must be submitted in writing via email to bookings@serenitymoroccotours.com.
9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, severe weather)
- Acts of terrorism or civil unrest
- Pandemics or epidemics
- Government actions, travel bans, or border closures
- Strikes or labor disputes
- Failure of critical infrastructure
In the event of Force Majeure, we will work with you to reschedule your tour or provide a credit for future travel. Refund policies under Force Majeure circumstances are detailed in our Cancellation Policy.
10. Intellectual Property
All content on our website and marketing materials, including text, graphics, logos, images, videos, and software, is the property of Serenity Morocco Tours or its licensors and is protected by copyright and trademark laws.
You may not:
- Reproduce, distribute, or modify our content without written permission
- Use our trademarks or branding for any purpose
- Create derivative works based on our content
- Use automated systems to collect data from our website
10.1 User-Generated Content
By submitting reviews, photos, or other content to us, you grant Serenity Morocco Tours a non-exclusive, royalty-free, perpetual license to use, reproduce, and distribute such content for marketing and promotional purposes.

If informal resolution is unsuccessful, either party may request mediation through a mutually agreed-upon mediator. Each party shall bear its own costs of mediation.
12.3 Arbitration
Any disputes that cannot be resolved through mediation shall be submitted to binding arbitration in Marrakech, Morocco, in accordance with the rules of the Moroccan Chamber of Commerce. The decision of the arbitrator shall be final and binding.
12.4 Time Limit for Claims
Any claim or dispute arising from our services must be brought within one (1) year from the date the cause of action arose. Claims not brought within this period are waived.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.
For matters not subject to arbitration, the courts of Marrakech, Morocco shall have exclusive jurisdiction.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. The date of the most recent revision will be indicated at the top of this page.
For bookings already confirmed, the Terms in effect at the time of booking will apply, unless the modifications are required by law or significantly benefit the traveler.
